Well they could open-source the code only, that would solve the problem.

Still can't see it happening though.

The Fallout engine, especially the version used in Fallout 2 has been pretty well reverse engineered by a bunch of hackers over the course of the last years. Recently a new topic was created at NMA:

IMHO the "easiest" option would be to create an open source Fallout engine that is compatible with the documented Fallout file formats. You could even use FIFE for the purpose (actually FIFE started as an improved Fallout-like RPG engine) or create one from scratch. I wouldn't count on Interplay to open source it.

I always wonder why companies do not want to give the source code away of ancient engines.

Nobody does any commercial game with such an ancient engine anyway.
